Please read these Terms carefully. They govern your use of PacketStream and limit PacketStream’s liability. If you do not agree, do not use the Services.
1. Agreement and eligibility
These Terms of Service (“Terms”) are an agreement between you and PacketStream Inc. (“PacketStream,” “we,” “us,” or “our”). They apply when you access packetstream.io, the PacketStream account dashboard, residential proxy services, the Packeter desktop client, reseller services and APIs, trial and contact forms, support, and related products or features (collectively, the “Services”).
By creating an account, clicking an acceptance control, installing or running PacketStream software, purchasing or using proxy bandwidth, accessing a reseller API, or otherwise using the Services, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally able to enter this agreement. If you use the Services for an organization, you represent that you have authority to bind it.
2. The Services
Proxy access
PacketStream provides access to a peer-to-peer residential proxy network. Customers may connect through supported HTTP, HTTPS, and SOCKS5 gateways, request country-level targeting, use automatic exit selection for new proxy connections, or request a sticky session for up to the published maximum duration. Exit availability changes continuously. A country-targeted request may fail when no suitable exit is available, and a sticky session may fail if its Packeter disconnects.
Packeter desktop client
The Packeter desktop client allows an account holder (“Packeter”) to contribute bandwidth from a Windows, macOS, or Linux device. While the client is running, customer traffic may be routed through the Packeter’s internet connection and public IP address. The client requires no inbound port forwarding. A Packeter may stop or uninstall it at any time.
Reseller services
Approved resellers may provide proxy access under their own brand and use PacketStream APIs to create and manage subaccounts, allocate bandwidth, and review usage. PacketStream does not expose PacketStream branding to a reseller’s end customers through the white-label service. The reseller owns the end-customer relationship and provides end-customer support; PacketStream provides support to the reseller.
Website, dashboard, forms, and support
The Services also include account registration and management, billing, downloads, documentation, support, contact and trial-request forms, and related communications. Trial credits are discretionary. PacketStream may decline a request or choose the amount of any trial credit based on the proposed use case.
3. Accounts and credentials
You must provide accurate, current information and keep it updated. You are responsible for protecting your password, proxy authentication key, reseller credentials, and other account credentials, and for all activity performed through them. Notify [email protected] promptly if you suspect unauthorized access. You may not sell, transfer, or share an account except through an approved reseller arrangement.
4. Proxy customer terms
- Residential proxy bandwidth is metered through the gateway at the price displayed when purchased. The standard public rate is $1.00 per GB with a $50 minimum purchase.
- Standard proxy access does not require a recurring subscription. Purchased account balance does not expire merely because time passes.
- Credit card and PayPal are the standard public payment methods. PacketStream may approve bank transfer for larger purchases at its discretion.
- To request a refund of remaining purchased balance, contact support within 24 hours of purchase. Refund eligibility remains subject to applicable law, payment settlement, and the amount of balance remaining.
- You are responsible for configuring your client correctly, protecting proxy credentials, and paying for all metered traffic attributed to your account.
- PacketStream does not guarantee a particular exit, country, IP address, response time, success rate, availability, or uninterrupted session.
5. Packeter terms
You may run the Packeter client only on a device and internet connection you own or are authorized to use. You are responsible for confirming that bandwidth sharing complies with your internet provider’s terms, local law, and any network-owner rules. Running the client consumes network capacity and may affect your connection.
PacketStream currently credits $0.10 per GB of eligible customer traffic routed through a Packeter connection. Cashout requests require at least $5 in eligible balance, are paid in USD through PayPal, are processed on a weekly schedule, and are subject to PacketStream’s 3% cashout fee. PayPal may impose separate fees. PacketStream does not guarantee that traffic will be routed through a Packeter or that any particular amount will be earned.
Proxy customers receive the public exit IP address and approximate geography needed to use the connection; they do not receive the Packeter’s PacketStream account identity from the proxy service. PacketStream may withhold, reverse, or invalidate earnings associated with fraud, manipulation, prohibited activity, measurement errors, or violations of these Terms.
6. Reseller terms
Reseller access requires approval and a minimum purchase or deposit of $500. Applicable bandwidth pricing and any additional commercial terms are those shown or agreed at purchase. Resellers are responsible for their end-customer agreements, privacy notices, billing, support, credential security, and lawful use of the Services by their end customers. Resellers must ensure their end customers follow these Terms and must cooperate with PacketStream regarding suspected violations.
7. Acceptable use
You may use the Services only for lawful purposes and only where you have any permission required by law, contract, or the operator of a target system. You may not use or help others use the Services to:
- commit fraud, deceive others, impersonate a person or organization, or manipulate PacketStream balances, measurements, referrals, trials, payments, or payouts;
- gain unauthorized access to accounts, systems, devices, networks, or data, or defeat access controls or security measures;
- distribute malware, interfere with services, conduct denial-of-service activity, scan for vulnerabilities without authorization, or compromise credentials;
- send spam or unlawful communications, harass or stalk others, or collect, use, or disclose personal data unlawfully;
- infringe intellectual-property, privacy, publicity, contractual, or other rights;
- conduct unlawful financial, payment, marketplace, government, or regulated activity;
- circumvent PacketStream restrictions, monitoring, metering, authentication, or safety controls; or
- violate applicable law or cause PacketStream, a Packeter, a reseller, or another person to violate applicable law.
PacketStream may investigate suspected violations, restrict destinations or traffic, require additional information, suspend access, or cooperate with service providers and lawful government requests. PacketStream is not obligated to disclose the design or operation of its safety and abuse-prevention measures.
8. Balances, credits, and taxes
Purchased balance, Packeter earnings, promotional or trial credits, reseller allocations, and other credits are different account entries and may have different rules. Purchased balance does not expire merely with time. Trial and promotional credits are discretionary and may be limited, revoked, or governed by terms stated when granted. You are responsible for taxes, duties, internet-provider charges, and other costs arising from your use of the Services.
9. Privacy and communications
Our Privacy Policy explains how PacketStream handles personal information and service data. You agree that PacketStream may send service, account, security, billing, and administrative communications. Where required by law, marketing communications will include a way to opt out.
10. Software and intellectual property
PacketStream and its licensors own the Services, software, documentation, trademarks, and related intellectual property. Subject to these Terms, PacketStream grants you a limited, revocable, non-exclusive, non-transferable license to use PacketStream-provided software and interfaces solely to access the Services for their intended purpose.
You may not copy, modify, sell, sublicense, reverse engineer, bypass, or create derivative works from the Services or software except where applicable law expressly permits it. This restriction does not prohibit an approved reseller from selling access under the reseller program in accordance with Section 6.
11. Third-party services and destinations
The Services interact with third-party networks, payment processors, websites, software, and service providers. PacketStream does not control third-party services or the content, policies, availability, or security of destinations you access. Your use of them may be governed by separate terms and privacy policies.
12. Changes, suspension, and termination
PacketStream may modify, suspend, limit, or discontinue all or part of the Services. We may suspend or terminate an account or connection when we reasonably believe it presents security, legal, fraud, payment, operational, or abuse risk; violates these Terms; is required by law; or threatens PacketStream, Packeters, resellers, customers, or third parties. You may stop using the Services at any time and may request account closure through support.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKETSTREAM DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PACKETSTREAM DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR SUITABLE FOR A PARTICULAR DESTINATION OR WORKLOAD.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKETSTREAM AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, USE, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.
15. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PacketStream and its affiliates, officers, employees, agents, and licensors from claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising from your use of the Services, your traffic or end customers, your violation of these Terms or law, or your infringement of another person’s rights.
16. General terms
These Terms and the Privacy Policy are the entire agreement concerning the Services unless you and PacketStream enter a separate written agreement. If a provision is unenforceable, the remaining provisions remain effective. PacketStream’s failure to enforce a provision is not a waiver. You may not assign these Terms without PacketStream’s written consent; PacketStream may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets.
Except where applicable law requires otherwise, these Terms are governed by California law without regard to conflict-of-law principles, and disputes must be brought in the state or federal courts located in Los Angeles County, California.
17. Updates and contact
PacketStream may update these Terms. Material changes will be posted with a revised “Last updated” date and may also be communicated through the account dashboard or email. Continued use after an updated version takes effect constitutes acceptance where permitted by law.
